In this paper I consider recent discussions within the representationalist theories of phenomenal consciousness, in particular, the discussions between first order representationalism (FOR) and higher order representationalism (HOR). I aim to show that either there is only a terminological dispute between them or, if the discussion is not simply terminological, then HOR is based on a misunderstanding of the phenomena that a theory of phenomenal consciousness should explain. First, I argue that we can defend first order representationalism from Carruthers' attacks (...) and ignore higher order thoughts in our account of phenomenal consciousness. Then I offer a diagnostic of Carruthers' misunderstanding. In the last section I consider further reasons to include mindreading abilities in an explanation of phenomenal consciousness. (shrink)

This report highlights and explores five questions that arose from the workshop on sensory substitution and augmentation at the British Academy, March 26th through 28th, 2013.

One of the central limitations of sensory substitution devices (SSDs) is their inability to reproduce the non-sensory feelings that are normally associated with visual experiences, especially hedonic and aesthetic responses. This limitation is sometimes reported to cause SSD users frustration. To make matters worse, it is unclear that improvements in acuity, bandwidth, or training will resolve the issue. Yet, if SSDs are to actually reproduce visual experience in its fullness, it seems that the reproduction of non-sensory feelings will be of (...) some importance. We offer a novel solution. Researchers can produce hedonic and aesthetic responses by eliciting these feelings artificially, pairing distal objects that should be pleasurable to pleasurable stimulus outputs from the SSD. We outline two strategies for accomplishing this: first, by means of a prefixed, hardwired, association of pleasant distal objects to pleasant stimulus outputs from the SSD; second, by means of a flexible, feedback-based association which creates associations based on a subject-directed matching of distal objects to patterns of stimuli from the SSD which the subject takes to have the corresponding hedonic properties. We evaluate some problems with both strategies, and we argue that the feedback-based strategy is more promising. Researchers can use this strategy to help the blind, allowing them to take pleasure in the objects they perceive using SSDs. (shrink)

In this paper I would like to demonstrate how some forms of Neurotheology offer a symptomatic characteristic of our current culture, where Science acts as an all-embracing knowledge —it aspires to explain the entire aspect of reality— ignoring the limits of its method. Actually, some researchers transgress the principles of the scientific-experimental method and extrapolate to philosophical and theological issues. In this way, they overlap the epistemological limits of the different kinds of knowledge to become one only. Thus, science carries out, to say the least, a naturalist reductionism. (shrink)

Feminist studies of female genital cutting (FGC) provide ample evidence that many women exercise effective agency with respect to this practice, both as accommodators and as resisters. The influence of culture on autonomy is ambiguous: women who resist cultural mandates for FGC do not necessarily enjoy greater autonomy than do those women who accommodate the practice, yet it is clear that some social contexts are more conducive to autonomy than others. In this paper, I explore the implications for autonomy theory (...) of these understandings of the relation between culture, FGC, and women’s agency. I review the range of worldwide FGC practices – including “corrective” surgery for “ambiguous genitalia” in Western cultures as well as the various initiation rites observed in some African and Asian cultures – and the diverse cultural rationales for different forms of FGC. I argue that neither latitudinarian, value‐neutral accounts of autonomy nor restrictive, value‐saturated accounts adequately explain women’s agentic position with respect to FGC. I then analyze a number of educational programs that have enhanced women's autonomy, especially by strengthening their introspection, empathy, and imagination. Such programs, which engage women's autonomy skills without exposing them to autonomy‐disabling cultural alienation, promote autonomy‐within‐culture. This understanding of autonomy as socially situated, however, entails neither endorsement of FGC nor resignation to its persistence. (shrink)

Ever since Freud pioneered the “talking cure,” psychologists of various stripes have explored how autobiographical narrative bears on self-understanding and psychic wellbeing. Recently, there has been a wave of philosophical speculation as to whether autobiographical narrative plays an essential or important role in the constitution of agentic selves. However, embodiment has received little attention from philosophers who defend some version of the narrative self. Catriona Mackenzie is an important exception to this pattern of neglect, and this paper explores Mackenzie’s work (...) on embodiment and self-narrative with the aim of better understanding the adequacy of autobiographical narrative as an account of the agentic self. I argue that Mackenzie’s narrative account of embodied subjectivity and agency is incomplete, for it over-estimates the reach of narrative and underestimates the cognitive and agentic powers of the lived body. Purpose. The main objective of this article is to discuss the suitability of moral and ordre public clauses, and to advance the view that ethical reflection within patent systems is valuable. Methodology. This is a conceptual paper that draws upon the present situation in Europe to illuminate a discussion of the different views about the morality patents, with particular emphasis on criticism of authors who have espoused a narrow interpretation of moral clauses, such as that adopted by the EPO. Findings. (...) This research found that the claim that patent systems are not appropriate places in which to evaluate moral matters and, therefore, they cannot inform us about morality, is false. This is because inventors do not need to wait for authorizing legislation prior to making use of their technology. Hence, moral implications can be evaluated. Practical implications. It is shown how the bioethicist community can be incorporated into patent offices. The responsibilities of examiners and businesses in the process are also discussed. Research limitations/implications. These ideas also lead to important theoretical consequences, especially regarding the debate on value-laden science and technology. However, further efforts are needed to address other patent regimes, such as the non-European. Originality. There have been a limited number of studies that examine the value of ethical considerations within the patent system. This article provides a thought-provoking discussion of moral clauses in Europe. I also suggest new ways of incorporating ethical scrutiny into patent systems. (shrink)

My aim is to extend and complement the arguments that others have already made for the claim that women who are citizens of economically disadvantaged states and who have been trafficked into sex work in economically advantaged states should be considered candidates for asylum. Familiar arguments cite the sexual violence and forced labor that trafficked women are subjected to along with their well-founded fear of persecution if they’re repatriated. What hasn’t been considered is that reproductive rights are also at stake. (...) I explain how reproductive rights are implicated in sex trafficking. Moreover, I contend that sex traffickers’ abuse of women’s reproductive rights is persecutory and that that this persecutory abuse obliges destination states to offer asylum to transnational sex trafficking victims. I start by sketching reproductive human rights doctrine. I then examine studies of women who are in post-trafficking recovery programs in order to ascertain the impact of their past experience of forced sex work on their reproductive freedom and health. On the basis of these findings, I maintain that, among other outrages, sex trafficking systematically violates victims’ reproductive human rights. In view of this abuse, women trafficked into sex work might seem to be prime candidates for asylum in destination states. Yet, economically well-off destination states are not particularly receptive to this idea, and international law provides some justification for their chilliness. Preliminary to challenging them, I explicate four ways in which international anti-trafficking law and international refugee law interfere with viewing women trafficked into sex work as refugees and approving their applications for asylum. The second half of my paper aims to overcome those legal obstacles. In the interest of parsimony and because there are many continuities between U.S. refugee law and anti-trafficking law and the policies of similar destination states, I focus mainly on the U.S. in this part of the paper. To anchor my argument, I spotlight two precedents in refugee law for taking reproductive human rights seriously and several precedents for treating trafficked women as members of a distinct social group as required by refugee law. I then urge that a law enforcement gestalt has gained undue influence over U.S. legal practices where anti-trafficking law intersects with refugee protection law. A human rights gestalt is needed as a counterweight, for otherwise victims of sex trafficking and the reproductive abuse they’ve suffered are erased. Taking up a human rights perspective and mobilizing the precedents I’ve identified, I show that respecting the reproductive human rights of women who have been trafficked into sex work entails that affluent destination states must recognize their right to asylum. It is often said that human rights are the rights that people possess simply in virtue of being human – that is, in virtue of their intrinsic, dignity-defining common humanity. Yet, on closer inspection the human rights landscape doesn’t look so even. Once we bring perpetrators of human rights abuse and their victims into the picture, attributions of humanity to persons become unstable. In this essay, I trace the ways in which rights discourse ascribes variable humanity to certain categories of (...) people. I set the stage for my discussion of the human in relation to human rights by examining John Locke’s account of the justification for punishment. For Locke, in committing a crime one abrogates one’s humanity and forfeits one’s rights. Likewise, I argue, human rights discourse takes a scalar view of humanity. I consider victims of genocide who are dehumanized as helpless and passive, victims of state persecution who are super-humanized as righteously agentic, and perpetrators of genocide who are dehumanized as out-of-control beasts. In each case I use relevant testimony to argue that the scalar view of humanity is factually incorrect and morally deplorable. For genocide victims, I discuss testimony that Selma Leydesdorff gathered from women who survived the Srebrenica massacre. For a victim of persecution, I discuss Liao Yiwu’s memoire of his detention and imprisonment in China because of his artwork protesting the Tiananmen Square massacre. For perpetrators of genocide, I discuss testimony Jean Hatzfeld gathered from Hutu men who systematically murdered Tutsis in the Rwandan genocide. Finally, I apply my critique of dehumanized and super-humanized victims and dehumanized perpetrators to the problem of transnational trafficking in persons and argue that the view I advocate necessitates reforming immigration policy with respect to persons trafficked into forced labor. In this study, I aimed to carry out a comparative analysis of the methods of conversational philosophy and sage philosophy as contributions towards overcoming the problem of methodology in African philosophy. The purpose was to show their points of convergence and probably, if possible, their point of divergence as well. I did not intend to show that the method of one is superior or inferior to the other. The objective was to provide an analysis to show that the two methods (...) are essentially the same with little variations. Thereafter, I highlighted their significance as methods of doing African philosophy and discussed their problems as well. I used the methods of analysis and hermeneutics. From the study, I concluded that conversational philosophy is an extension or a modified form of sage philosophy. The implication of this conclusion is that sage philosophy and conversational philosophy should overlap each other in research and purposes. (shrink)

En no pocos momentos de la historia ha habido claudicaciones generalizadas ante esa búsqueda, olvidos más o menos conscientes de que las verdades se alcanzan si se mantiene la esperanza de sabiduría y el amor a ella. El relativismo y el escepticismo se presentan casi como el polo opuesto de esa esperanza y ese amor; como una consecuencia de la “con-fusión” cultural, de las mentiras interesadas y de la desidia moral de algunas sociedades. La nuestra, la europea occidental, es una de ellas. El relativismo afecta al modo de pensar y de comportarse del hombre y es habitual que le lleve por vericuetos que a la postre terminan dañándole a él y a sus congéneres. En este libro se analizan algunos errores que han llevado a suscribir las tesis del relativismo y a rechazar la posibilidad de dar con algunas verdades comunes para todos. La obra tiene dos partes, una histórica y otra temática. Las páginas con enfoque histórico estudian las tesis que sobre el relativismo han mantenido algunos pensadores o corrientes de la filosofía. De su lectura se puede extraer la conclusión de que el fenómeno del relativismo es tan viejo y tan actual como el propio hombre y su apertura inteligente a la verdad. Filósofos de la época antigua de la talla de Protágoras, Pirrón o los “Académicos” coetáneos de San Agustín; modernos como Descartes; contemporáneos como Wittgenstein o Kuhn han dejado huellas que luego abrieron el camino hacia un régimen de pensamiento en que el hombre abandona la posibilidad de admitir verdades universales. Algunos argumentos favorables al relativismo —y, más aún, algunas actitudes “propedéuticas” de él— se han ido instalando culturalmente hasta consolidarse de manera cada vez más indiscutida. La segunda parte analiza el relativismo de forma temática, como un asunto abordable desde las diversas ramas del saber filosófico. Desde la consideración de Tomás de Aquino del conocimiento por connaturalidad, "el conocimiento que aporta a la inteligencia más datos que los puramente racionales, especialmente todos los datos proporcionados por la afectividad", es posible hacer un acercamiento integral a la realidad y establecer una relación con otras áreas de sabiduría y sus objetos de estudio. Esto ayuda a confrontar algunos problemas filosóficos reales, como la pérdida de la visión holística de la realidad, el reduccionismo epistemológico y el relativismo gnoseológico. Recordar (...) el estudio iniciado en la primera parte del siglo XX por tomistas bien conocidos sobre la connaturalidad ayudaría a comprender mejor la realidad y el ser humano, y facilitaría el diálogo entre Filosofía, Ciencia y Teología sobre temas como Ecología, Estética o Mística. O debate fomentado nos anos oitenta entre liberais e “comunitaristas” tende a contrastar radicalmente as concepções teóricas de John Rawls e Charles Taylor, sendo o primeiro o representante principal da vertente liberal e o segundo do “comunitarismo”. Ao contrário do que sustenta essa distinção, neste artigo proponho ir para além dela, a fim de defender que há convergências dos autores no que tange à discussão sobre o pluralismo. Em um primeiro momento, apresento os diagnósticos de Rawls e de Taylor quanto (...) ao fato do pluralismo nas sociedades modernas como uma característica contextual irreversível (I). Em um segundo momento, diante da tensão ética insuperável entre divergentes concepções bem, a saída mais viável caminha para a justiça. Para tanto, desenvolvo a concepção de “justiça política” de Rawls em “O Liberalismo Político” e as publicações mais recentes de Charles Taylor como em “Secularism and Freedom of Conscience”, “A Secular Age” e “Why We Need a Radical Redefinition of Secularism?”, que parecem sustentar certa “virada liberal-rawlsiana” no pensamento do autor (II). Em um terceiro momento, efetuo uma distinção entre o fato do pluralismo (razoável) e o valor do pluralismo, para finalmente concluir o artigo argumentando que tanto Rawls como Taylor tendem a defender o pluralismo como um valor político para as instituições e não como um valor moral abrangente para os indivíduos. Philosophers have had surprisingly little to say about the concept of a victim although it is presupposed by the extensive philosophical literature on rights. Proceeding in four stages, I seek to remedy this deficiency and to offer an alternative to the two current paradigms that eliminates the Othering of victims. First, I analyze two victim paradigms that emerged in the late 20th century along with the initial iteration of the international human rights regime – the pathetic victim paradigm and the (...) heroic victim paradigm. Holocaust victims are quintessential instances of the pathetic victim paradigm. They are marked by passivity and innocence in the face of overpowering force and unspeakable humanly inflicted suffering. Aung San Suu Kyi is an exemplar of the heroic victim paradigm – prisoners of conscience, in Amnesty International’s terms. Because heroic victims face off against the repressive power of the state to fight injustice, they are by no means passive, but they must be innocent of wrongdoing – that is, they must use nonviolent means of dissent – to qualify as heroic victims. Second, I problematize the asymmetrical conceptions of innocence that underwrite the two victim paradigms. Whereas the pathetic victim paradigm identifies innocence with passivity, the heroic victim paradigm countenances agentic victims and adverts to a universalist, absolutist stance on the limits of the legitimate use of state power to ascribe innocence to heroic victims. Both conceptions of innocence are out of keeping with well established social and legal practices regarding what constitutes coercive force and innocent victimhood. Consequently, there is reason to be skeptical of the two victim paradigms. Third, I identify two kinds of human rights violations and two categories of victims that AI defends despite their failure to fit the two paradigms – women trafficked into sex work and prisoners on death row. In many cases, women forced to do sex work are not innocent girls who are ignorant of the trafficking system and who helplessly fall prey to smugglers. They are desperately poor women who for that reason are willing to take enormous risks to try to relieve their own and often their families’ deprivation and suffering. Although these women act nonviolently for irreproachable reasons, they lack the public political agendas that characterize heroic victims. Unless non-fulfillment of subsistence rights is recognized as a form of overpowering force that inflicts severe, avoidable suffering, these women do not qualify as pathetic victims either. The victim paradigms pose an even greater obstacle to recognizing that the death penalty is a human rights violation and that death row prisoners are victims. Because a jury concluded that these individuals committed heinous, violent crimes, they are excluded by the heroic victim paradigm. Only if death row prisoners can be proven (usually through DNA evidence) not to have committed the crimes for which they were convicted can these individuals qualify as pathetic victims. In the absence of any reason to believe that they are innocent and especially if they are unrepentant, they are widely regarded as brutal victimizers of others who deserve no sympathy for, let along relief from, the suffering they “brought on themselves.” Finally, I confront the Othering of victims that results from the two victim paradigms, which leads many victims to eschew the label, thereby opting out of human right discourse. I propose revisions in the victim paradigms that eliminate the real-world exclusions they sponsor as well as the Othering of victims of human rights abuses. In particular, I endorse greater attention to what people and the institutions they create do to other people, and I favor a presumption that unnecessary and severe humanly inflicted suffering is a human rights violation. Moreover, I reject the innocence criterion embedded in the two paradigms and urge that it be replaced by a burdened agency criterion. These modifications better align the concept of a victim with a realistic understanding of human subjectivity and agency and allow for a more capacious understanding of who is a bearer of human rights and under what conditions right-holders become victims of rights violations. Jenny Saville is a leading contemporary painter of female nudes. This paper explores her work in light of theories of gender and embodied agency. Recent work on the phenomenology of embodiment draws a distinction between the body image and the body schema. The body image is your representation of your own body, including your visual image of it and your emotional attitudes towards it. The body schema is comprised of your proprioceptive knowledge, your corporeally encoded memories, and your corporeal proficiency (...) with respect to various environments and activities. Saville is concerned with body image issues, and I discuss how she reconfigures representational practices with respect to feminine body images. However, the most exciting potential for feminist analysis of the state of the female nude derives from the concept of the body schema, for this concept endows the human body with subjectivity and agency. My key question, then, is by what pictorial means and to what extent Saville succeeds in representing agentic womanhood. I argue that interpreting Saville’s paintings from the standpoint of the body schema demonstrates the radicality of her remaking of the female nude and the rapport between her imagery and feminist values. Phenomenal qualities are embodied spaciotemporal abstractions subjectively perceived by a conscious observer. Specific examples, i.e., qualia, include the color purple, the taste of chocolate, and the fragrance of a rose. The question of whether phenomenal awareness can be empirically understood forms one important facet of the “Hard Problem of Consciousness” (Chalmers, 1995, pp. 200–219). It is the position of this analysis that we will never understand why we experience sensory qualities in the manner we do until we first comprehend how (...) they may have evolved in the very distant past. This examination explores the evolutionary development of phenomenal experience. In so doing, it proposes that behind the mechanisms through which external stimuli interface with our sensory apparatus, there lies a long evolutionary process of standardization, approximation, and synchronization that has ultimately forged the close links between the two. The consistent and efficient correlations that the resultant evolutionary links give rise to cumulatively generate conscious experience. There is a tight correspondence between our sensations and incoming stimuli, and this synchronous covariance is meaningful and functional; however, it does not result from a strict cause-and-effect relationship between the physical properties of external objects and our internal neurophysiology. As such, this investigation endorses Hoffman’s (1998, 2003, 2008, 2009) view that the external world is largely hidden from direct sensory evaluation. The following inquiry utilizes Jung’s (1952) “Acausal Connecting Principle” to further explore the concept of complementary sensory phenomena as it may have originally been envisioned by Wolfgang Pauli. (Meier, 2001) This thesis, with respect to meaningful acausality and synchronicity, is first used to provide a plausible explanation for the initial genetic development of color perception, and then employed to examine the analogous evolutionary ties that ultimately engender all sensory modalities. Without invoking the Quantum-Mind hypothesis, this paper supports the idea that our five senses are not direct, or true, or even approximate abstract representations of any underlying material properties of incoming stimuli; instead, they efficiently provide useful higher-order assumptions pertaining to the macro properties of spacetime, matter, and motion, as well as the causal-objective of all life. The overall investigation concludes that it is the structural categorization, hierarchical organization, and qualitative characterization of this indirect presumptive meta-information that has engendered meaningful sensory experience, and all conscious thought over evolutionary time. This paper addresses two related topics: 1. The disanalogies between elective cosmetic practices and sex reassignment surgery. Why does it seem necessary for me – an aging professional woman – to ignore the blandishments of hairdressers wielding dyes and dermatologists wielding acids and scalpels? Why does it not seem equally necessary for a transgendered person to repudiate sex reassignment procedures? 2. The role of the body in identity and agency. How do phenomenological insights regarding the constitution of selfhood in relation (...) to the interplay between the body image and corporeal know-how contribute to an account of the agency of transgendered individuals? Studying several paintings by contemporary feminist artist Jenny Saville has advanced my thinking on these topics. Saville’s imagery is an invaluable aid to reflection on these issues because she uses her painterly technique, which critics often dub “virtuoso,” to represent lived human bodies. In her work, viewers encounter representations of subjectivized, agentic corporeity, as distinct from inert, objectified flesh. Moreover, her sympathetic engagement with nonconformist, devalued bodies helps to reconfigure the standard gestalts of the human body that viewers typically carry with them and thus to convert fear and/or disgust into appreciation and understanding. In this paper, I consider three of Saville’s paintings. Plan, Saville’s self-portrait as a nude female whose body has been prepped for liposuction, conveys the pathos of this procedure. Matrix is a nude portrait of self-described “gender variant visual artist” Del LaGrace Volcano. In the words of one critic Saville’s depiction of Volcano’s nude intersexed body “restores beauty to the primitive [female] genital organ.” Passage, another nude portrait of an intersexed individual, is an image of vibrant sexuality despite the presumptively jarring juxtaposition of breasts and a penis. I argue that conceiving the agentic subject as a rational deliberative capability that uses a conjoined body as the instrument of its will makes it impossible to theorize the agency of transgendered people. In contrast, when agentic subjects are understood as embodied subjects and embodiment is understood as a dimension of practical intelligence, the agency of transgendered individuals is intelligible. This paper explores the relation between victims’ stories and normativity. As a contribution to understanding how the stories of those who have been abused or oppressed can advance moral understanding, catalyze moral innovation, and guide social change, this paper focuses on narrative as a variegated form of representation and asks whether personal narratives of victimization play any distinctive role in human rights discourse. In view of the fact that a number of prominent students of narrative build normativity into their accounts, (...) it might seem obvious that there is a connection between victims’ stories and moral insight. However, the category of victims’ stories spans an enormous variety of texts – private diaries, memoirs written for publication, interviews with journalists or social scientists, depositions prepared by human rights workers, stories shared with like-minded activists or with support groups, stories told to medical professionals, and testimony in courts, truth commissions and asylum hearings, to mention just some of the possibilities. The different contexts of elicitation and the different rules governing expression in these sites should make us wary of ready generalizations about the nature of victims’ narratives. Moreover, I doubt that existing explications of the way in which norms figure in narratives yield satisfactory theories of the contribution victims’ stories can make to discovering and defending just policies and practices. I consider two of the most prominent accounts of the relation between narrative and normativity. For different reasons, the account Anthony Amsterdam and Jerome Bruner present in their work on narrative and law and the account Hayden White presents in his work on narrative and history fail to appreciate the capacity of victims’ stories of abuse to advance understanding of and increase respect for human rights. In defense of the value of victims’ stories, I propose an account of the relation between normativity and a salient type of victim’s narrative that seems especially resistant to integration into human rights discourse. -/- . In this paper we advance a new solution to Quinn’s puzzle of the self-torturer. The solution falls directly out of an application of the principle of instrumental reasoning to what we call “vague projects”, i.e., projects whose completion does not occur at any particular or definite point or moment. The resulting treatment of the puzzle extends our understanding of instrumental rationality to projects and ends that cannot be accommodated by orthodox theories of rational choice.

In this study, I demonstrated that there is a corporate social contract between firms and their host communities. The implication is that the idea of the social contract places corporate social responsibility (CSR) on a conditional pivot, whereby the host communities have to fulfil their own side of the contract in order to merit CSR projects. I examined the implication of the social contract for corrupt and unaccountable host communities. I based my analysis on two philosophical frameworks, namely: one, Constructive (...) Approach CSR (CA-CSR), and two, Restorative Approach CSR (RA-CSR). CA-CSR is hinged on the deontological and utilitarian moral frameworks, while RA-CSR is based on the restorative justice framework. Further, I developed ‘CSR Calculus’ (V = f1+n + K) to determine the value of CSR-due for a host community, in response to Milton Friedman questions of arbitrariness in the formulation of CSR projects. I also demonstrated how the CSR Calculus can be applied to determine the value of CSR owed communities by Micro, Small and Medium scale Enterprises (MSMEs). Finally, I used the ethic ‘leave a better community’ derived from the Annang proverb – Assidsip ye Akwot-kwot ete yak mfin ami afon akan mkpong (Assidsip and Akwot-kwot say make today better than yesterday) to signpost the corporate social contract and demonstrated why it is essential for every firm to commission and decommission its operations in socially responsible manner such that it can bequeath a better future society. In 2015, Fainos Mangena published an essay entitled “How Applicable is the Idea of Deep Ecology in the African Context?” where he presented a number of arguments to support his thesis that deep ecology as discussed in the West has no place in the African context. Mangena later presented a counter-version of deep ecology that he claims is based on African philosophy. In this paper, I interrogated Mangena’s arguments for rejecting deep ecology and found that they were based on certain (...) erroneous presuppositions. Further, I developed a critique of Mangena’s Shona version of deep ecology which shows it to be impractical, unappealing, and based on a misunderstanding of the true nature of the modern African environment. The problem of time has been present throughout history of philosophy since its beginnings. However to consider what is time is not a matter of technical theorization, conversely, this results interesting in as much as a reflection on the nature of world, and even the human particularities, cannot evade time problem. Aristotle is a stage under obligation in history of philosophy. My main purpose is to understand why time is problematic and what difficulties we have to meet with (chapter one). (...) On the other hand, I'm interested in the way Aristotle give an account of these difficulties in virtue of the relation among movement or change, magnitude and time, as well as the latter character of number (chapters two and three). This study is basically an investigation into the probabilities of place and how such probabilities affect concepts and propositions as they travel through time. I develop the concept of time as a place and argue that time is an infinite phenomenon, which is neither fixed, static, monolithic nor objective. I show that when concepts cross ontological jurisdictions they loss their truth-values because their formative meanings are radicalized by the time zone through which they travelled. The dynamicism of time itself implies (...) that concepts should not be employed in absolute sense at any circumstance. Truth-value is a travelling concept. As a travelling concept it is historical – it depends on what happened. What this demonstrates is that the determinant of truth-value of a concept or proposition is not merely the rules of logic but time constellations. I have demonstrated this in the context of intercultural philosophy by showing the pitfalls that should be avoided when one deals with concepts that travel through time. Truth is a continuous rather than a discreet variable. (shrink)

In this paper, I aimed to study the relationship between postmodernism and phenomenology. In the study, I established that postmodernism and phenomenology bear similar ontological marking, which base their concepts and methodologies on an individualistic framework. On the basis of such ontological framework, phenomenology, in particular, postulates a method of studying phenomena, which involves individuating and isolating the phenomena from horizon and holding them as separate individual entities. The purpose is to enable the phenomenon or object to stand out and (...) be seen clearly as it is in itself. In this way, it is expected that the true essence of the object will be visible and projected. I have found this conceptual framework inadequate in the study of phenomena and grasping of their true essences and meanings. I argue that bracketing off the horizon in order that the object may clearly stand out will transform the object into another object different from its original form. To solve this observed problem, I introduced the concept of “afriphenomenology”, which is a phenomenological theory and methodology that is based on African ontology. Afriphenomenology, basing its premises on African ontological experience, holds that objects and phenomena are interconnected, interrelated, interdependent and complementary. For this reason, when phenomena or objects appear they do so as cohort, cluster, correlative and interconnective entities or events rather than as individuated and unrelated realities. Therefore, to grasp the true essence and meaning of an object or a phenomenon will involves studying the object or phenomenon in relations with the correlative objects and phenomena. Citing example of the events that led to the discovery of the planet Neptune, I show how afriphenomenology can help us discover new information about objects and phenomena. (shrink)

Traditional philosophical problem arises from the distinction between being and non-being, something and nothing, what is and what is not. The objective of this paper is about proving that the distinction can be a framework for conflict resolution, by showing the problem to be a result of misunderstanding of the logical relations of the units. Two study questions are developed to guide the research: (i) what is the nature/structure of the logical relation between being and non-being, and (ii) how does (...) an understanding of that relation feed into conflict and peace discourse. The two research questions are contextualized or articulated under the following conceptual frameworks: (i) Parmenidian disjunctive ontology, and (ii) Heideggerian conjunctive ontology. In conclusion, the paper proves Hedeggerian conjunctive ontology to be adequate framework for negotiation of conflict, by showing conflict to be a result of the Parmenidian error of misunderstanding the logical relation of being and non-being as disjunctive rather than conjunctive. This article contributes to the ongoing discussion on African aesthetics by presenting concept of beauty or the beautiful as it evolved from the cultural conception of beauty to the philosophical shift in the concept. It also examined Western concept of beauty in order to show the different contexts of the meaning of beauty in Africa and Western philosophies. In the paper, I focused primarily on analyzing beauty concept in terms of what constitutes beauty and how the beautiful can be known. (...) I showed that unlike individualistic conception of beauty in Western philosophy, beauty concept in African philosophy is both relational and functional. I showed that in African context there is no beauty for beauty’s sake; and that the beautiful is considered in terms of good conducts and physical attractiveness. Finally, I argued that African concept beauty is only intelligible when considered in the context of African ontology. (shrink)

In this study, I aimed to subject to philosophical analysis the scientific data from biological science researches that are conducted into the phenomenon of homosexuality in order to give philosophical interpretation to it thereby establishing the normative values of the scientific findings. From the study, I observed that much of the scientific data on homosexuality established the phenomenon as ingrained in the human biological construct. I argued that although homoeroticism is biological construct of the homosexual, parenting plays significant role in (...) the sexual identity ultimately developed by an individual. I have presented three conceptual frameworks to show how this happens. I determined that homoeroticism and homosexuality are not exactly the same thing; homoeroticism is a biological construct, while homosexuality is a social construct. I also determine that sexual orientation (which results from eros) is not necessarily the same thing as sexual identity (such as homosexuality or heterosexuality, which results from socialization processes). I argued that sexuality is a synthesis of dialectical interactions between the factors internal within and external to the homosexual’s body; but that the external is conditioned by the internal. I adopted the paradigm of existentialism as the philosophical framework for the analysis. In conclusion, I argued that if the homosexual’s sexual orientation is native biological construct of his/her body, then the homosexual has no control over his/her sexual orientation. The philosophical implication of that finding is that homoeroticism is facticity; and as facticity the homosexual cannot escape from being homosexual. Despite this, I used the Two-Way Test (TWT) to show that homosexuality is immoral act; although the homosexual is not an immoral person. However, I have demonstrated that the failed moral status of homosexuality is not enough ground to criminalize homosexuality. (shrink)

In this article, I examined the various ethical problems raise to morally discount homosexuality. I found that so far no moral argument proved adequate ground to discount homoeroticism. However, I have developed the ‘Two-Way Test’ (TWT) by which the social acceptability of any sexual relation should be tested for moral validity. From the analysis, homosexuality was found to have failed the test. That is to say, homosexuality is not a morally valid act. Despite that, the immoral status of homosexuality did (...) not constitute sufficient ground for its criminalization, because not all immoral acts are criminalized but only those that impede the right or liberty of others. In conclusion, the paper submitted that although homosexuality had failed the TWT it does not call for violence, criminalization and discrimination against persons of homosexual orientation but that homosexuals should be accommodated without deliberately discouraging heterosexual relationship. My advocacy for sexual tolerance is based on the grounds that ongoing biological research has so far shown the phenomenon as biological reality beyond the personal control of most homosexuals. It is not uncommon for people to suffer identity crises. Yet, faced with similarly disruptive circumstances, some people plunge into an identity crisis while others do not. How must selfhood be construed given that people are vulnerable to identity crises? And how must agency be construed given that some people skirt potential identity crises and renegotiate the terms of their personal identity without losing their equilibrium -- their sense of self? If an adequate theory of the self and agency must (...) be able to account for this capacity to avert identity crises, I argue that it must include an account of agentic corporeity. After explaining what an identity crisis is, I examine Charles Taylor’s and David Velleman’s accounts of identity and agency and argue that their omission of agentic corporeity makes it impossible for them to convincingly account for the ability to avert an identity crisis. In the spirit of Merleau-Ponty’s account of the intentional arc and J. J. Gibson’s account of the relation between corporeity and affordances, I sketch an account of psychocorporeal practical intelligence that includes three main components – psychocorporeal insight, psychocorporeal values, and psychocorporeal versatility. I conclude by connecting my position to Aristotle’s views about practical understanding and by arguing that both Taylor and Velleman have reason to embrace my position. (shrink)

Diana Pérez (2005) criticizes Davidson’s argument for the thesis that there is no thought without language, and offers an alternative defense of that thesis on the basis of empirical studies on developmental psychology. In this comment I argue that more recent studies do not seem to affect Davidson’s argument in the way Pérez suggests, and that her alternative defense of the thesis that there is no thought without language is insufficient. At the end, I offer a sketch of how (...) a weaker and more tenable version of the argument could be articulated. (shrink)

I provide a manipulation-style argument against classical compatibilism—the claim that freedom to do otherwise is consistent with determinism. My question is simple: if Diana really gave Ernie free will, why isn't she worried that he won't use it precisely as she would like? Diana's non-nervousness, I argue, indicates Ernie's non-freedom. Arguably, the intuition that Ernie lacks freedom to do otherwise is stronger than the direct intuition that he is simply not responsible; this result highlights the importance of the (...) denial of the principle of alternative possibilities for compatibilist theories of responsibility. Along the way, I clarify the dialectical role and structure of “manipulation arguments”, and compare the manipulation argument I develop with the more familiar Consequence Argument. I contend that the two arguments are importantly mutually supporting and reinforcing. The result: classical compatibilists should be nervous—and if PAP is true, all compatibilists should be nervous. Sergio Tenenbaum and Diana Raffman contend that ‘vague projects’ motivate radical revisions to orthodox, utility-maximising rational choice theory. Their argument cannot succeed if such projects merely ground instances of the paradox of the sorites, or heap. Tenenbaum and Raffman are not blind to this, and argue that Warren Quinn’s Puzzle of the Self-Torturer does not rest on the sorites. I argue that their argument both fails to generalise to most vague projects, and is ineffective in the case of the (...) Self-Torturer itself. (shrink)

The principal thesis in this review-essay is that the key linguistic terms in Fichte’s Wissenschaftslehre especially have two main meanings that appear at first sight to be almost in contradiction or opposed to each other. The reader of Fichte therefore has to work hard to overcome any apparent conflicts in the “double sense” of his philosophical terminology. Accordingly, I argue that Fichte’s linguistic method and use of language should be seen as part of his chief philosophical method of synthesis, where (...) we have to carry out a similar procedure and attempt to reconcile opposites using the power of the imagination. This thesis is put forward by means of a number of practical examples and in the context of some critical reflections on the recently published Cambridge Companion to Fichte, eds. Conditionalists say that the value something has as an end—its final value—may be conditional on its extrinsic features. They support this claim by appealing to examples: Kagan points to Abraham Lincoln’s pen, Rabinowicz and Rønnow-Rasmussen to Lady Diana’s dress, and Korsgaard to a mink coat. They contend that these things may have final value in virtue of their historical or societal roles. These three examples have become familiar: many now merely mention them to establish the conditionalist position. But the (...) widespread faith in such cases is, I believe, unjustified. This is because, surprisingly, the pen, the dress, and the coat cannot have final value. I argue that the problem is internal: these cases are ruled out by every conditionalist account of final value. Further, the problem with these well-known cases applies to most other supposed examples of extrinsic, final goods. Thus nearly all cases given to support the conditionalist view cannot succeed. I suggest a kind of diagnosis: I claim that these examples are best seen as instances of sentimental value, rather than final value. I close by providing a brief account of sentimental value and explain how it relates to instrumental, intrinsic, and final goodness. (shrink)

Alfred Mele’s zygote argument is widely considered to be the strongest version of the manipulation argument against compatibilism (about free will and determinism). Opponents have focused largely on the first of its two premises and on the overall dialectic. My focus here will be on the underlying thought experiment—the Diana scenario—and on the second premise of the argument. I will argue that reflection on the Diana scenario shows that the second premise does not hold, and we will see (...) that my objection to the second premise helps to defend the claim that manipulation arguments face, in general, a dilemma. The Louvre Museum is the largest of the world's art museums by its exhibition surface. These represent the Western art of the Middle Ages in 1848, those of the ancient civilizations that preceded and influenced it (Oriental, Egyptian, Greek, Etruscan and Roman), and the arts of early Christians and Islam. At the origin of the Louvre existed a castle, built by King Philip Augustus in 1190, and occupying the southwest quarter of the current Cour Carrée. In 1594, Henri IV decided (...) to unite the palace of the Louvre with the palace of the Tuileries built by Catherine de Medicis. The Cour Carrée was built by the architects Lemercier and then Le Vau, under the reign of Louis XIII and Louis XIV. The Department of Paintings currently has about 7,500 paintings (of which 3,400 are exposed), covering a period that goes from the Middle Ages to 1848 (date of the beginning of the Second Republic). By including the deposits, the collection is, with 12,660 works, the largest collection of ancient paintings in the world. With rare exceptions, the works after 1848 were transferred to the Musée d'Orsay when it was created in 1986. From the perspective of realist philosophy the key (...) seems to be found in an appropriate articulation between consciousness and subjectivity. En la cúspide del conocimiento humano halla su sede la sabiduría. Un saber que se alcanza en la simplicidad más alta del ser humano, allí donde confluyen todas sus potencias y facultades, no solamente la inteligencia, sino también la voluntad y los afectos. Cualquier clase de conocimiento aséptico respecto de cualquier influencia afectiva o volitiva lleva a una reducción que de manera propia puede llamarse “intelectualismo”. El concepto de razón “pura” es un reduccionismo que conduce a una grave disgregación en (...) la criatura racional, y a la enajenación de su mismo ser. El que no conoce amando y no ama conociendo, ni conoce verdaderamente, ni verdaderamente ama. El conocimiento que compendia estas características antropológicas se denomina “conocimiento afectivo”. En este trabajo se hace una exploración sobre el alcance de este tipo peculiar de conocimiento siguiendo los principios de Aristóteles y Tomás de Aquino. (shrink)

Los distintos enfoques sobre la persona, resaltan aspectos esenciales del ser humano: desde su dignidad y valor supremo original hasta su proyección social y política, dentro de un contexto histórico determinado. La variedad de problemas planteados y de fundamentos filosóficos expresados a lo largo de las distintas exposiciones, ponen (...) de manifiesto la inmensa riqueza que el tema ofrece, especialmente para entender en profundidad el verdadero sentido de la vida humana, su origen y destino, su realización en el tiempo histórico y su proyección hacia el futuro. Social contract is one of the most common schemes for justifying patents. According to this theory, inventors obtain a commercial exclusivity in exchange for the disclosure of the invention, with the final aim of allowing others to use that knowledge in future innovations. Under the rationale of this social contract theory of patents, if a patent system is not guided by impartiality in its decisions, the relation between disclosure of inventions and future innovation becomes an issue, because non-merit factors in (...) patent examination influence the quality of the knowledge disclosed. The aim of this article is to analyse impartiality in patent systems and, by doing so, defend that there is an epistemic side on both impartiality and social contract theory. (shrink)

El estudio acerca de la influencia de las pasiones en el voluntario libre ha sido recurrente en la tradición tomista. Sin embargo, las causas de los dos efectos psicológicos de la intentio volitiva mencionados por Tomás de Aquino, la redundantia y la distractio, pasaron desapercibidas, y podrían aclarar algunos comportamientos consecuencia de la dinámica de las pasiones del hombre. La acción de la intentio volitiva originada por los afectos, al alcanzar cierto grado de intensidad, puede llegar a sobrepasar el control (...) de la voluntad y la inteligencia. Además, otro punto original de esta temática es que, a la par que el influjo de “abajo hacia arriba” (pasiones hacia la voluntad) —algo ya mencionado por Aristóteles cuando habla de la intemperancia y por los medievales en el estudio de la voluntad—, también puede detectarse otro de “arriba hacia abajo” (influjos afectivos superiores que influyen en la inteligencia —conocimiento afectivo⎯ y ésta sobre la voluntad), de tal manera que cierto tipo de concentraciones psicológicas hacen que la persona deje de tener sensaciones somáticas hasta producirse en él evasiones temporales, trances inconscientes y efectos extremos similares. Finalmente, desde el punto de vista de la Historia de la Filosofía, este trabajo también muestra que ha habido un olvido en el estudio de esta faceta volitiva de la intentio, ya que se ha estudiado sobre todo su aspecto ético, pero sin relación con la intentio cognoscitiva (“intencionalidad”). En cualquier caso, las tesis sobre la intentio y sus efectos muestran cómo es preciso rebasar el estudio del ámbito natural-biológico para completarlo con el ámbito personal-cultural. (shrink)

En 1968 Raquel Carson comenzaba una revolución en el pensamiento, quizá una de las de mayor peso en la actualidad. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican.
